W. (Bill) Cuthill, Jr. (Cuthill), Chapter 11 Trustee for Evergreen Security, Ltd. (Evergreen), has advised the Official Creditors Committee for Evergreen that he will object to all claims filed by a trust or intermediary, which do not identify the underlying investor in Evergreen. If trusts or other intermediaries file claims for the investor, which duplicate the investor’s claim, Cuthill will object to the duplicate claim filed by the trust or the intermediary. Cuthill is aware the debtor filed its schedules, not including the names and addresses of more then half of the total investors in Evergreen. Cuthill will file a motion allowing him to amend the schedules to include the missing investor names and addresses and add them to the matrix so they can be notified of the bankruptcy filing. Cuthill will additionally file a motion to extend the bar date so that all investors may file claims after being noticed by the Court.
